Terms of Use and Terms of Sale

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "Customer") and Fusionride LLC, a North Carolina limited liability company with headquarters at 1204 Birchbark Rd, Durham, NC 27705 ("Company," "we," "us," or "our"). These Terms govern your access to the Fusionride LLC website and the purchase of any products, including the ShredLORD snowboard suspension system. Our Shipping Policy, Return Policy, Digital Product Policy and Privacy Policy are incorporated into and form part of these Terms. Where they conflict with these Terms, the specific policy controls on its subject matter.

1. ACCEPTANCE AND ELIGIBILITY

By accessing our Services or placing an order, you represent that you are at least 18 years of age and possess the legal authority to enter into this agreement. If you are using the Services on behalf of a company, you represent that you have the authority to bind that entity.

2. MODIFICATIONS AND RIGHT TO CHANGE CONTENT

We reserve the right to change, modify, or remove the contents of the Services or these Terms at any time and for any reason at our sole discretion without notice.

Terms of Service: If we make material changes, we will update the "Last Updated" date. Your continued use of the Services after revised Terms are posted constitutes your acceptance.

Product & Pricing: We reserve the right to modify or discontinue any product (including specifications and features) or change pricing at any time. We shall not be liable to you or any third party for any modification, price change, or discontinuation. The version of these Terms in force when we accept your order governs that order.
Promotions: We may introduce, change or withdraw promotional offers, including free-shipping thresholds and discount codes, at any time. Withdrawing an offer does not affect orders we have already accepted.

3. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Services, including the ShredLORD brand, logo, website design, text, photos, video, and downloadable PDF manuals/booklets, are our proprietary property and are protected by United States and international copyright and trademark laws.

4. PRODUCT USE, SAFETY, AND DISCLAIMERS

Recreational Use Only: All products, specifically the ShredLORD snowboard suspension system, are designed and intended strictly for recreational use. They are not intended for professional competition or extreme stunts beyond the parameters of the documentation provided.
Mandatory Documentation: You acknowledge that the User Manual, Warranty, and Safety Warnings booklet are available for download in PDF format. Successful installation and safe operation are your responsibility. Failure to adhere to these manuals increases the risk of serious injury or death and voids the warranty.
Assumption of Risk: Snowboarding is an inherently dangerous activity. By using our products, you voluntarily assume all risks associated with the sport.

5. TERMS OF SALE, PAYMENTS, AND SHIPPING

Order Acceptance: We reserve the right to refuse any order. Orders are not binding until accepted by us via a confirmation email. An automated acknowledgment of receipt is not acceptance; acceptance occurs when we send the shipment confirmation.
Pricing and Errors: Prices are in US dollars unless the checkout states otherwise, and exclude sales tax, VAT, GST and similar taxes, which are added or charged as described below. If a product is mispriced or listed in error and the correct price is higher, we will contact you before shipping so that you can confirm the order at the correct price or cancel it for a full refund.
Payment: Payments are processed through Wix Payments. You represent that your payment information is accurate and that you are authorized to use the designated payment method. Payment is taken when the order is placed. If we cannot fulfill an accepted order we refund it in full to the original payment method.
Shipping Timeframe: Where a shipping time is stated on the product page or at checkout, we aim to ship within that time, and in any event within 30 days of receiving your properly completed order unless we tell you otherwise. If we cannot meet that date we will notify you and you may accept a revised date or cancel for a refund.
Shipping Charges and Free Shipping: Shipping charges are calculated and shown at checkout. Free standard shipping applies to orders with a merchandise subtotal of US$500 or more delivered within the contiguous United States, and US$700 or more delivered internationally, measured after discounts and before shipping, taxes and duties. Full conditions and exclusions are in the Shipping Policy.
Customs, Duties and Import Taxes: International orders ship Delivered at Place (DAP), with import taxes and duties post-paid by the receiver. Import VAT or GST, customs duty, customs handling and carrier brokerage fees are payable by the recipient as importer of record on delivery, are set by the destination country, and are not included in the price or in any free-shipping offer. If you refuse a shipment because of those charges, we refund the merchandise price less our outbound carriage, any return carriage billed to us and any duties or taxes we cannot recover.
Address Accuracy: You are responsible for the accuracy of the delivery address you provide. If a shipment is returned to us as undeliverable because the address was incorrect or incomplete, we will re-ship it once you pay the reshipment cost, or refund the merchandise less our outbound and return carriage.
Shipping & Risk of Loss: We ship via USPS, UPS, FedEx and other major carriers. Title and risk of loss pass to you upon our transfer of the product to the carrier. Delivery dates are estimates and are not guaranteed. For consumers in the EU/EEA and the United Kingdom, risk passes on delivery, as required by law. Loss and damage in transit are handled as set out in the Shipping Policy.

6. RETURNS AND EU RIGHT OF WITHDRAWAL

Standard Returns: We accept returns of unused products in original packaging within 30 days of delivery. Contact support@fusionride.at for a return authorization before sending anything back; returns sent without one may be refused. You pay return carriage, a restocking fee of 5% of the merchandise price is deducted from the refund, and original shipping charges are not refunded. None of this applies where the item was defective, damaged or incorrectly supplied: in that case we pay return carriage, charge no restocking fee, and replace the item or refund it, at our option, unless the law where you live gives you the choice. Where a partial return brings the order below a free-shipping threshold, the shipping cost we originally absorbed is deducted from the refund. Refunds are issued to the original payment method promptly after we receive and inspect the goods. Full terms are in the Return Policy.
EU/EEA Right of Withdrawal: Consumers in the EU/EEA have the right to withdraw from this contract within 14 days of receiving the goods without giving a reason. To exercise this right, you must provide a clear statement of withdrawal. You may use the model withdrawal form published on our website or send any other clear statement to support@fusionride.at. We will refund all payments received from you, including the cost of standard outbound delivery (we are not obliged to refund the additional cost of a faster service you chose), within 14 days of receiving your notice, and we may withhold the refund until we have received the goods back or you have supplied evidence of having sent them. No restocking fee is charged on a statutory withdrawal. You are responsible for the direct cost of returning the item. You are liable for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning, and we may deduct that amount from your refund.
United Kingdom: consumers in the United Kingdom have an equivalent 14-day right to cancel under the Consumer Contracts Regulations 2013, on the terms set out above.
Digital items: downloads such as manuals and wallpapers are covered by the Digital Product Policy. Where a digital item is supplied before the withdrawal period ends, you consent to immediate supply and lose the right of withdrawal for that item only.

7. LIMITED 1-YEAR WARRANTY

We provide a Limited Warranty for one (1) year from the date of purchase against manufacturing defects in materials and workmanship. This warranty is strictly limited to the terms provided in the Warranty PDF and does not cover normal wear and tear, accidents, or unauthorized modifications. This warranty is in addition to, and does not affect, the statutory guarantee of conformity available to consumers in the EU/EEA and the United Kingdom, which runs for a minimum of two years from delivery.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, FUSIONRIDE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THE USE OF OUR PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE PRODUCT. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR FRAUD, OR FOR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING UNDER MANDATORY CONSUMER PROTECTION AND PRODUCT LIABILITY LAW IN THE EU/EEA AND THE UNITED KINGDOM.

9. GOVERNING LAW

These Terms shall be governed by the laws of the State of North Carolina, USA. You consent to the exclusive jurisdiction of the courts in Durham, North Carolina, for any disputes. This choice of law and forum does not deprive a consumer of the protection of the mandatory rules of the law of the country in which that consumer is habitually resident, and does not prevent a consumer resident in the EU/EEA or the United Kingdom from relying on the jurisdiction rules that apply to them.

10. PROMOTIONS AND PROMOTIONAL SHIPPING OFFERS

Promotional offers, including free-shipping thresholds and discount codes, are subject to the conditions published with the offer and in the Shipping Policy. Unless stated otherwise: one offer per order; offers are not combinable; offers are measured on merchandise subtotals after discounts and before shipping, taxes and duties; offers are not applied retroactively; and we may amend or withdraw an offer at any time without affecting orders already accepted.

11. COMPLAINTS AND DISPUTE RESOLUTION

13. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, that provision applies to the maximum extent permitted and the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it.
